Ryley Carlock Shareholder Publishes Employee Drug Testing Article

An article by Mike Moberly titled “Weeding Out Risky Employees: Little Guidance for Arizona in Landmark Medical Marijuana Ruling” has been published in the June 2016 issue of Arizona Attorney. The article discusses the Colorado Supreme Court’s widely reported decision in Coats v. Dish Network, which upheld an employer’s right to terminate an employee who tested positive for off-duty marijuana use even though the use of marijuana for both medicinal and recreational purposes has been legalized in Colorado. Despite the far-reaching employment law implications the Coats decision may have in other states in which marijuana has been legalized, the article concludes that the decision’s impact in Arizona is likely to be negligible due to the broader and more explicit statutory protections accorded employees under the Arizona Medical Marijuana Act.
