Ryley Carlock & Applewhite Brings Cutting Edge FDA and Advertising Law Capabilities to the Southwest

Former Patton Boggs Attorney Susan D. Brienza, Ph.D., Joins the Firm

Ryley Carlock & Applewhite, a leading regional law firm located in Arizona and Colorado, today announced the addition of Susan D. Brienza, Ph.D., who will be a shareholder in the firm's Phoenix office. She joins the firm from the Denver office of Patton Boggs.

Ms. Brienza helps clients navigate complex federal laws relating to the manufacture, labeling, importing, marketing and sales of health and wellness products. Her main focus is helping clients answer a key question: What do consumers want, and how can marketers deliver it?

Among the areas/products about which Ms. Brienza advises clients are:

Weight Loss Products and Claims

Energy Drinks, Sports Drinks and Hydration

Body Building Supplements

Face Creams & Cosmeceuticals (Drug vs. Cosmetics)

Superfoods and Medical Foods

Websites, infomercials, social networking, expert endorsements & consumer testimonials related to the products above.

"Regulatory compliance in the world of OTC health products, dietary supplements and organic foods is a vital business in any economy" said Rodolfo Parga, Jr., Ryley Carlock & Applewhite's Managing Shareholder. "In the Southwest and the Intermountain West, there is a keen interest in the types of natural products and wellness businesses represented by Susan Brienza, and we are very fortunate to have the opportunity of bringing her on board," he said.

Ms. Brienza's practice involves keeping clients in compliance with Federal Trade Commission (FTC) law and United States Department of Agriculture (USDA) regulations, as well as Food and Drug Administration (FDA) laws and regulations. In addition to regulatory compliance and enforcement matters, she assists in litigation, with particular emphasis on product liability and advertising cases. She has also been involved in white-collar criminal defense work and lobbying/public policy matters.

"I had some choices to make when I decided to concentrate on a growing regional firm," said Ms. Brienza. "The more I learned about Ryley Carlock, the easier that selection became," she said. "This will be a great platform from which to service my clients and to grow the compliance practice even further, "she said.

"Susan has a remarkable story: I was impressed by how serving on jury duty in two trials led her to law school and a second career," added William Scott Jenkins, Jr., recruiting shareholder at the firm. "Her FDA experience will be a welcome capability in Arizona, and her vast knowledge of emerging issues in the ever-changing world of nutraceuticals will both complement and diversify our practice," he said.

Before entering the field of law, Ms. Brienza was a university professor in stylistics and 20th Century American and British literature. She brings her proficiency in language and her deep knowledge of rhetoric to her regulatory compliance practice, especially in crafting attractive labeling and ad claims. She earned her law degree from Stanford, her Ph.D. in English from the University of Pennsylvania, and her B.A. from Yale University, where she had the distinction of being in the first graduating class of women in that University's history.

In addition to her regulatory compliance practice, Ms. Brienza has written and presented on nanotechnology-in particular, to what extent EPA and FDA will monitor and govern devices and products made with nanomaterials. She was one of 30 invited participants at a two-day symposium in May 2010 on Nanotechnology and Policy, hosted by Notre Dame's ND Nano Center, and also participated in two international Nano and Renewal Energy Summits, sponsored by the national trade association NanoBusiness Alliance.

"Ryley Carlock is in expansion mode," said Mr. Parga. "We are not growing for growth's sake, however, but are selectively and strategically finding great lawyers who are also great people who fit with our strategic plan," he said.

Note: Ms Brienza is licensed only in Colorado, and her practice is limited exclusively to Federal Law.
